API Terms of Use

1. Acceptance of API Terms

The Hobigate API (the "API"), operated by Hobigate ("We", "Us", or "Our"), allows You to access and use certain data and functionality through our application programming interface. These API Terms of Use explain the terms and conditions that apply to Your use of the API.

By accessing or using the Hobigate API in any manner, you unconditionally consent and agree to be bound by and be a party to these API Terms of Use and our general Terms of Use and Privacy Policy. If you do not agree to these terms, please do not use our API.

These API Terms are in addition to our general Terms of Use. In case of conflict, these API Terms shall prevail with respect to API usage.

("You" or "Your", as used in these API Terms of Use, refers to, and includes, not only the individual accepting these API Terms of Use but also any legal entity that employs such individual or that such individual is acting for or on behalf of.)

2. API Access and Authentication

Access to the Hobigate API requires:

  • Valid API credentials (API key or OAuth token)
  • Compliance with rate limits and usage restrictions
  • Proper authentication headers in all API requests

You are responsible for maintaining the confidentiality of your API credentials. Do not share your API keys publicly or commit them to version control systems.

3. Rate Limits and Usage Restrictions

The Hobigate API is subject to rate limiting to ensure fair usage and system stability:

  • Rate limits may vary by endpoint and are subject to change
  • Excessive requests may result in temporary or permanent API access suspension
  • You must implement appropriate caching and request throttling in your application
  • Automated scraping or bulk data collection without permission is prohibited

4. Acceptable Use

You agree to use the API only for lawful purposes and in accordance with these terms. You agree not to:

  • Use the API in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the API
  • Use the API to build competing services or replicate Hobigate's functionality
  • Resell or redistribute API access or data obtained through the API
  • Use the API to transmit malicious code, viruses, or harmful content
  • Overload or attempt to overload our servers with excessive requests
  • Use automated tools to access the API without proper authorization

5. Data Usage and Attribution

Data obtained through the Hobigate API:

  • Is provided for your use in accordance with these terms
  • May include data from third-party sources (TMDB, IGDB, Open Library, CheapShark) and Hobigate's own databases (HobigateDB)
  • Must be used in compliance with the terms of those third-party sources
  • Should be attributed appropriately when displayed publicly
  • Data from HobigateDB (user-contributed data) is subject to the license terms in Section 4 of our Terms of Use

Third-Party and Internal Data Sources: Our API may include data from the following external sources and our own databases:

  • TMDB (The Movie Database): For movies, TV shows, and anime data. You must comply with TMDB's Terms of Use and API Terms of Use
  • IGDB (Internet Game Database): For video game data. You must comply with IGDB's terms of service
  • Open Library: For book data. You must comply with Open Library's terms of use
  • CheapShark: For game price comparison and deal data
  • HobigateDB: Data from Hobigate's own community-created databases (BooksDB, PeopleDB, CharacterDB, etc.). This data is created through community contributions and is subject to Section 4 of our Terms of Use

You are responsible for ensuring that your use of API data complies with all applicable laws and third-party terms of service. You must provide appropriate attribution to these data sources when displaying data obtained through our API.

Attribution Requirements: When displaying data obtained through our API, you must include appropriate attribution to the data sources. This may include displaying logos or text attributions as required by the respective third-party services.

6. Intellectual Property

The Hobigate API, including its design, functionality, and documentation, is the intellectual property of Hobigate. You do not acquire any ownership rights by using the API.

Content accessed through the API may be subject to copyright and other intellectual property rights of third parties. You are responsible for respecting those rights.

7. API Changes and Deprecation

We reserve the right to modify, update, or discontinue the API at any time. We will make reasonable efforts to:

  • Provide advance notice of significant changes or deprecations
  • Maintain backward compatibility when possible
  • Document all changes in our API documentation

However, we are not obligated to maintain any specific version or functionality of the API.

8. Termination of API Access

We may suspend or terminate your API access at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these API Terms
  • Abuse or misuse of the API
  • Security concerns
  • Legal or regulatory requirements

9. Disclaimer of Warranties

The API is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the API will be:

  • Uninterrupted or error-free
  • Free from defects or bugs
  • Available at all times
  • Compatible with all systems or applications

10. Limitation of Liability

YOU AGREE THAT YOUR USE OF THE API WILL BE AT YOUR SOLE RISK. WE WILL NOT BE LIABLE TO YOU FOR ANY LOSS OF ANY DATA (INCLUDING CONTENT) OR FOR LOSS OF USE OF THE API.

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE API, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT, OUR LIABILITY TO YOU IN RESPECT OF ANY LOSS OR DAMAGE SUFFERED BY YOU AND ARISING OUT OF OR IN CONNECTION WITH THESE API TERMS OF USE OR YOUR USE OF THE API, WHETHER IN CONTRACT, TORT OR FOR BREACH OF STATUTORY DUTY OR IN ANY OTHER WAY, SHALL NOT EXCEED $50, WHERE SUCH AMOUNT APPLIES TO ALL YOUR CLAIMS IN AGGREGATE AND NOT JUST FOR ANY INDIVIDUAL CLAIM.

SOME STATES OR JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES, OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF YOU RESIDE IN ONE OF THESE STATES OR JURISDICTIONS, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

11. Indemnity

You agree to indemnify and hold Us, Our affiliates, licensees and licensors and Our and their respective officers, directors, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Your use of the API, Your violation of these API Terms, or Your violation of any third-party terms of service.

12. Miscellaneous

A. Entire Agreement

These API Terms of Use, together with our general Terms of Use and Privacy Policy, constitute the entire agreement between You and Us regarding the API and supersede any prior or contemporaneous understandings and agreements.

B. Severability

If any provision or part of a provision of these API Terms of Use is unlawful, void, or unenforceable, that provision or part of the provision is deemed severable and shall not affect the validity and enforceability of any remaining provisions.

C. Changes to API Terms

We reserve the right to modify or replace these API Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to use the API after those revisions become effective, you agree to be bound by the revised terms.
